TERMS AND CONDITIONS
Present terms and conditions (hereinafter referred to as “T&C”) are applicable to any booking made through Qualistay GmbH. T&C align with the General Travel Terms and Conditions (ARB 1992) of the Austrian Chamber of Commerce.
Qualistay GmbH (hereinafter referred to as “Qualistay”, “we”, “us” or “our”) serves solely as an intermediary between an entity or a person (e.g. property manager, home owner etc.) that lists an accommodation available for rent on the Qualistay web-site (hereinafter referred to as “Accommodation Provider”) and a person, who requests a booking of the accommodation listed on Qualistay web-site (hereinafter referred to as “Guest” or “you”), from the point when you make your reservation until your booking is confirmed by the Accommodation Provider and you receive from us a booking confirmation and contact details of the Accommodation Provider.
1. Contract Conclusion
A booking can be effected in writing or verbally. Qualistay should immediately confirm verbal booking(s) in writing.
The Guest, who makes a booking for himself or for a third party, is regarded as the principal contractor and, in the absence of a declaration stating otherwise, accepts the obligations under the awarded contract towards Qualistay (payments, contract cancellation, etc.).
2. General Information
a. Information on passport, visa, customs and health regulations
Please, make sure you have a valid passport and a visa for travelling abroad. The Guest is responsible for complying with customs and health regulations of the destination country. Travel insurance is highly recommended.
b. Information regarding Qualistay listings
Qualistay listings present accommodations of Accommodation Providers to its best knowledge and based on the information provided by Accommodation Providers.
3. Booking and Payment Policy
Upon receipt of your booking request, Qualistay will notify you about the availability of the requested accommodation. In case the accommodation is available, you will receive a corresponding email with the price of the booking and payment instructions. When confirming a booking, we will request a service fee and advance payment. Only after receiving the service fee and advance payment to our Paypal or Bank account (depending on the payment method you have chosen) your booking will be confirmed to you in a separate email. In this email we will also provide you with contact details of the Accommodation Provider. Consequently, the Accommodation Provider will further advise you on check-in/check-out arrangements, directions and other respective information. Please, note that once your booking is confirmed, you enter into a direct (legally binding) contractual relationship with the Accommodation Provider. In general, the remaining balance is due upon the check-in the latest. However, please, see payment conditions of a particular listing of interest.
4. Minimum stay and rates
Minimum stay and rates vary from accommodation to accommodation. Please, refer to the terms of a particular listing you are interested in. Please, note that, if not indicated otherwise, all rates are per property, per night and include taxes. Our service fee is 10% of the grand total amount of the stay cost less a security deposit amount. Please, note that you might be requested to pay a local tourist tax upon arrival. 5. Security Deposit
You will be asked to provide a security deposit upon check-in, which is fully refundable upon or after (depending on the property) your departure. However, charges for damage that is more than normal wear and tear, missing items, loss, excessive cleaning or any unpaid rent resulting from your stay will be deducted from your security deposit. We do not charge a service fee for the security deposit amount.
6. Cancellation Policy
You have the right to cancel your booking. Each accommodation listed with us has its own cancellation policy. Please, see the cancellation policy of the specific accommodation you are interested in. Please, note that after the booking is confirmed, the service fee is not refundable.
Normally, the Accommodation Provider should not cancel the booking after it has been confirmed unless the reason for that is your failure to provide an advance payment described in the payment conditions, to follow the payment schedule or to pay the amount due upon arrival, or in the event of your no-show. In the event of the cancellation by the Accommodation Provider for one of the reasons described above, the property cancellation policy will apply and a service fee will not be refunded.
Should the booking be cancelled by the Accommodation Provider for another reason, e.g. in case of a force majeure event, the Accommodation Provider should provide you with a similar or higher type and class alternative accommodation in the same geographical area free of charge. If this is not possible, you will get a refund of the total amount paid. Qualistay, from its side, will investigate an incident and, depending on the cancellation reason, may decide to suspend or terminate listing of the property in question.
The number of Guests is restricted to the number described. Additional Guests must be disclosed and approved. Weddings, receptions, parties or functions are not permitted on the property unless otherwise approved ahead of time. Any use of the property for other than strictly family vacation purposes or by any non-permitted occupant(s) may result in the termination of your contract with the Accommodation Provider and eviction from the premises.
8. Cleaning fee
A cleaning fee for cleaning the property after your departure is mandatory and, depending on the property, might or might not be included in the rate. Please, see a specific listing of interest for cleaning fee policy.

10. Conflict resolution
We are diligently selecting our business partners and accommodations they provide. We make sure, when inspecting a property, that it meets our minimal quality standards. However, we do not have any technical means to continuously control the quality of services our partners provide. Information that we disclose is based on the information provided to us by Accommodation Providers. Our photos depict the property at the moment we have inspected it. Qualistay is not liable for service rendering procured and/or arranged through it. You must address your complaints directly to the Accommodation Provider. Qualistay, however, may at its own discretion, serve as a mediator in a conflict resolution.
In case of a dispute with Qualistay, you have a right to submit your complaint to us in writing within 60 days after the booking has been confirmed to you. We will respond to you within 15 working days. In every case the contracting parties will try first of all to settle the dispute amicably. If the dispute is not resolved amicably within 60 days, the complainant may submit the dispute to the courts of the Republic of Austria.
To the extent permitted by law, these T&C and the provision of our services shall be governed by and construed in accordance with Austrian law.

Properties offered for rental reflect the tastes of each owner. Every effort has been made to assure accurate descriptions. Changes in inventory or items and/or decor occur from time to time and such changes will not void or alter the terms of the rental agreement.
Distances to the nearby locations (e.g. beach, supermarket, etc.) are approximate.
You are not allowed to resell, deeplink, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information (text, graphical image, photo or video), products or services available on our website for any commercial or competitive activity or purpose.
